(January 2008) I have decided not harvest ladybugs this winter so that I can focus on my nursery business. I will not be accepting ladybug orders until the middle of May.  I will not be doing any bio control orders until then. The best quality ladybugs that I know of are at A-1 Unique, call them at 916-961-7945

Currently we are about -15- days behind with our current orders of fruit tree shipping. Some orders are leaving more quickly, some take a little longer. Let us know if you have an urgent issue and need to have your fruit tree there in a hurry.

If your plant arrives in poor condition please go right away to the Terms and Conditions Page and follow those procedures outlined there, it will protect your interests and result in a more speedy resolution to any problems.

Tree and Shrub & Other Potted Plant Ordering

Step One; place your order online, or call for a consultation.

Step Two; When you make your order you may simply select the option of paying with a Purchase Order, type Kita into the purchase order number field or enter an American Express credit card number into a secure server, Visa Master Card and Discover customers will get an invoice back for payment.

Step Three: We will email you back an invoice with any seasonal plant charges, such as potted rose prices, packing and shipping expenses. After you get your Quick Books invoice you can then use your Visa, Master Card or Discover card to complete your order process. You may also mail a check.

Step Four; You will get back an invoice confirming payment has been made.

Step Five; Expect that it will be on average at least 3 to 10 days before we able to pack and ship your order, it often it may take only a day or two, but because of high order volume or seasonal supply problems it may take longer. If it is a gift then let us know so that we can put your order to the front of the line.

Terms and Conditions 

These terms and conditions are binding whether you are making your purchase over the phone, via mail order or through the shopping cart function.  

All changes in orders made by customers, including cancellations must be made email or fax 805-525-1481. Cancellation or request of refund of an order must be submitted to us 10 days prior to requesting a refund from your credit card provider. Keep in mind that like most nurseries many plants are not in our current inventory and need to be brought in from regional growers. This takes about 3 to 7 days from the date of your order if you any questions on current inventory E-mail us. Failure to do so will result in us being charged a fee. Should you not give us written notice that you are canceling or requesting a refund of your order (which is not a problem, if you don't want the merchandise and it is on special order, not packed up or in transit) you agree to pay the cost of the services charges. When ever you file a dispute about a credit card transaction that action may cost the company you are doing business with a lot of service charges. Get in touch first and try to resolve the problem. In our case we require 10 days from the time we get written notice of a problem to verify the disputed circumstances of your order, often it only takes a day or two. But in high season it make take longer.

Payment And Ordering

It is not necessary to enter your credit card number to make an order from us. Since many products involve shipping and packing expenses that need to be manually figured out based upon the items in your order, and your shipping location. You can simply choose the payment option of PURCHASE ORDER and then enter KITA for your order number. When you make your order will review for the cost of shipping and availability. You are not charged for your order at time of purchase. Master Charge, Visa, Discover & AMEX users will get back an invoice from Quick Books with any shipping expenses that may be incurred. After you approve of any changes in your initial order we will then process your order for payment. If you make changes after your order has started, we will charge you according to the costs incurred in getting your order ready and send you the billing paper work with your shipment. If you do not want to pay for your order at this time then check either "Fax - Mail Order" option or the Purchase Order Option, or call us for a quote.

We do not hold merchandise for anything other than paid orders, unless a commitment to purchase has been made. If you have selected Mail Order or the PO option then you need to send in payment via check, money order or purchase order. You may also send this information and call us with your credit card number. DO NOT mail your credit card info, while we get orders like this all the time, it is Credit Card Russian Roulette and is not a good idea. It is far safer for us to call you to verify the order and get the number at that time. Retail customers may use the PO function and use their check number as the PO number. All Mail Order & PO bare root rose and tree orders must be paid for with 6 weeks prior to shipment to guarantee availability of the items you want.

Return Of Goods

Retail Orders: Plant material may not be returned under any circumstance without prior approval or notice to  Growquest and will require via email or fax confirmation. Plants are shipped according to industry specifications and meet those criteria. Rejection of plant material because of a change in needs, change in desired variety, budget needs, or for any other reason other than the actual quality and specifications of the plants will result in restocking charges. Please understand that returning plants via our own trucks, common carriers or any other shipping service may result in damage to those plants that will require weeks or months to grow back out. This renders them worthless for sales and thus cancels out any credit that could be posted to your favor. 

The best solution to this is know what you want before it is shipped, when the plant arrives contact the management of Growquest and resolve any differences. 

Commercial Orders: If your are landscape or nursery professional then you understand that under most circumstances once you buy it, you own it. If the plant material does not meet the agreed upon written specifications made prior to purchase then feel free to return the product. If the products meet the specifications, or variety and container requirements and free from disease then you own it and should make use of it. Where plant material is shipped and does not meet acceptable California nurseryman standards for commercial landscape plants then we accept responsibility for the product. Since their many plant varieties and not all have written specifications for the industry, buy and seller agree that the term "acceptable standards" shall be defined as being able to procure the same plant material from another licensed California plant grower.

Commercial Hold Orders: Since hold orders usually involve plants that we do not own and have to spend a great deal of time and expense in locating, buy assumes all responsibility for ownership of plant material placed under hold order purchases, after 7 days of purchase. Once a hold order has been placed you have 7 days to accept and pay for the material or not be unhappy some else may buy it. Once payment or deposit has been made on commercial hold orders and provided the plant material meets the standards specified in writing the buyer owns the plant material and fully responsible for all costs involved in maintaining or storing the plant material until pickup or shipment has been made.

Return Of Goods Costs

  • Dry goods may be returned for a restocking charge of 15% plus loss of any shipping and packing charges. Just send a note and let us know why you are returning the item. You will be given a refund. 

  • restocking charge of 15% of healthy potted plant material returned

  • restocking charge of 25% of healthy field dug olive trees

  • restocking charge of 15% of plants prepared to leave but still at point of origin

  • cost of any packaging

  • cost of any shipping to cover the basic expenses involved in returning the goods.

  • costs of delivery labor if any labor was involved.

  • costs of replacement, if needed of the plants in question. 

  • costs of any other charges incurred by Growquest or it's supporting companies, agents of staff.

  • There is no return of goods for commercial orders or field dug olive trees. People in the nursery and landscape trade understand that in exchange for lower prices there is the responsibility of knowing what you are asking for and having an use for it, prior to receiving it.

Damaged Shipments 

All damaged orders must be reported to us and the shipping company who brought your package within 24 hours of arrival via Email or fax 805-525-1481. If necessary we will replace all damaged or lost orders with a refill of the damaged  or lost items.  You must file a complaint with the carrier who brought you the shipment. Failure to file a complaint will void your right to a replacement shipment or adjustment to your final invoice. 

Buyer agrees that any damaged shipment will replaced with the same or like product for a similar price. Buyer agrees not to file for a refund with their credit card company for. Buyer understands that reshipment may not happen right away but may have to wait for more inventory, better weather or to find a better carrier.

With the exception to apartments, all perishable orders are shipped no signature required, unless we are directed to do differently. The reason for this is that if you are not there and the shipment will go back and forth between you and the freight company and it usually dies or spoils. If you are not sure what your schedule will be and your shipping location is not too safe then you may want the signature required or to be held for pick up by you.

Buyer understands that shipping live potted plants via boxes and cargo trucks is not a perfect means of shipping and that damage may result. Seller shall replace plants that are damaged to the point that it effects the plants ability to thrive or perform effectively. Minor or cosmetic damage such a major leaf drop is not common, but a requirement for immediate replacement. In the event that the damage is prolonged and problematic Seller agrees to replace the plant as weather and production inventory allows. 

Bare Root Roses & Plants,.  

We sell bare root plants throughout the United States and bring in our plants from late October through the middle of March and either keep them in nursery pots or bare root in cold storage. We will ship your bare root plants when the planting time is right for your area or as you indicate in your order or follow up emailWe sell roses throughout the United States and have our plants ready from late October through the middle of April and either keep them in nursery pots or bare root in cold storage. Cancellation of Orders

Cancellation or changes in your order MUST BE MADE IN WRITING via email or fax, faxed cancellations will get a returned fax. Cancellation of your order may be subject to the progress of your order, typically during bare root months your ordered is pulled and prepared for shipment within 48 to 72 hours of being placed. Not all potted plants listed here are on hand and some may require special arrangements to be shipped to you. Please keep in mind that in order to bring you this large of a selection you may be choosing from the inventory of many rose growers in the United States and a couple from Canada. Cancellation of orders that have been prepared to ship or special orders will result in a 30% restocking, plus package destruction costs. To contact us send an email or fax 805-525-1481

Credit card refunds will be made within 7 days of your written (email) request, often much sooner, depending on your credit card company this will post right away or several days later.

Money order or check paid orders will refunded via company check within 14 to 30 days. This is to protect us from cancelled and NSF checks. Any customer passing NSF check, or canceling a check on a order arrived or in transit on us will be responsible for the full cost of any adverse financial effects to Surf and Sierra Wholesale Nursery, LLC and or its share holders. A lien will also be filed on the property, all reasonable legal expenses and costs associated with the lien process and collection of the value of the order and expenses.

If you think that the quality of your plant is not what you paid for call us. While we are open to hearing your complaint and working to resolve the conflict. In the event of a claim of more than $50.00  some other agreed upon third party. In the mean time keep the plants in good health. Do not send the plants back to us, as they are already under stress and need to be hydrated and cared for properly right away.  

Damaged orders must be held at your site for the trucking company agent to inspect. All products leave here in good condition and we expect them to arrive to you in good condition. Damage sometimes occurs to shipments. In most cases we simply replace the damaged item. Damage claims amounting to more than $75 may require a third party to examine the  problem.

Freight Charges 

All cargo leaves the shipping location FOB. All costs of transport and packaging are entirely that of the buyer. For temperature sensitive orders may be adjusted upwards or downwards for the correct cost of shipping as weather conditions dictate. Potted plant charges can very widely. Buyer agrees to assume responsibility for all reasonable and normal costs incurred in shipping their order. Potted plant prices are not calculated until time of shipment or actual delivery. This is because the variables of potting soil and thus weight of the plant, plant height, distance from regional shipping points and carrier terminals, number and variety of plants in the order(s) among other factors. Buyer authorizes Seller to collect payment for shipping charges via means of payment of record. In the event the shipping charges are billed credit of a net 10 days will be extended to the Buyer.

Shopping cart freight charges for bio control orders and bare root BUSH rose orders are usually very accurate. Shopping cart shipping charges are not set for potted plants. The $9.99 check out charge is a default setting and will be applied as a credit to your final bill. Many times a credit on bare root bushes orders. No shopping cart or shipping program can or will be able to account for human error (ordering bare root roses for Texas in April or May or ladybugs going to Arizona or Florida in the summer) the dynamics of the packaging needed to ship various tree roses and potted plants in all of the different portions of the Country and climate factors.

We deliver anywhere with a minimum of lead-time, full or combination loads. Please call for delivery rates and minimum order requirements. It should be noted that when coordinating the delivery of a large quantity of specimen trees, several days in advance notice should be allowed for the collecting and loading of trees for delivery. In addition, certain size trees may create a wide load for a highway and special permits must be obtained in order to transport these loads. The unloading of the trees at their final destination is the responsibility of the customer, with the assistance of the driver of the delivery vehicle. The customer should make arrangements to have available any necessary equipment to off-load the tree.

For LTL trucking or common freight companies we bill the amount of the bill plus 15 percent administrative overhead when we make the payment and handle the paper work your behalf.
 

Fruit trees and potted roses are not typically ship Next Day Cargo, 2nd Day or 3 Day Select shipping, as this would cost between $85.00 to 185.00 for this kind of shipping.

Potted plants are typically shipped in the largest boxes possible to keep them in their "flowering glory." If you want them cut way back and a cheaper box sized used let us know.

Charges will be applied for any reshipments to incorrect addresses given to us.

We are not liable for damage to products when customers provide the wrong shipping information.

Buyer under no circumstance is allowed to refuse acceptance of plant material or bio controls that Buyer has ordered, if Buyer has not made a written cancellation of the sale. Cancellation must be 48 hours prior to shipment leaving. These products are perishable and are the property of the Buyer. Refusal of the shipment may result in a refund of Buyer's credit card, but also result in legal action to collect for damages to the cargo.

If you get a plant that is mistakenly sent to you instead of the plant you ordered then you agree to give it to charity or non profit organization, such as a school, church, botanical garden, 4H, Boy or Girl Scouts. Donate the plant in your or our name, either way it is to go to non profit group or you agree to pay for it less 30% from the retail price.

Finally acceptance and possession of the product without giving notice of the product not being damaged or in unsatisfactory condition at time of arrival voids any future claim.

Spam Blockers

It is Buyer's responsibility to adjust or input any information necessary to communicate with Growquest , DHL, Federal Express and its E-commerce partners. Growquest  is not liable for any damages, including those that lead to refunds that result from Buyers failure to allow free flowing communication from A Better Plant Grower  and its shippers or E commerce partners.

Non Warranty

Growquest  guarantees all plant material to be delivered in good condition and we exercise the utmost in care to keep all varieties true to name. However, each sale is made subject to the condition that should any plant material sold by  Growquest  prove to be otherwise, Growquest  liability shall be limited to only the actual sum already received for such material and no event shall  Growquest be held for any greater amount. 

Claims

Adjustment for claims must be made within 3 days via Email, after receipt of merchandise. Such claims must be made in writing via E mail, confirmed fax or certified mail. Once accepted in good condition we are no longer responsible for potted or well rooted plants. Damage as result of improper care, handling, planting, maintenance or the elements is the responsibility of the Buyer.

Special Offers & Promotions.  

We have special offers and promotions from time to time, they are apply only to orders paid for and booked at the time offers are being made by us. They are not  retroactive and the offers do not apply mail orders or purchase orders that have not been confirmed after the offers expire.

Plant & Packing Prices

Plant prices are listed here are just that, PLANT PRICES. These prices do not include the cost of delivery, packing and shipping. More often than not the plants are less expensive than those of a local nursery, many times a lot less. Unlike the local nursery we are happy to make you a good deal when you are buying a lot of plants or a few large plants. That does not mean they are cheaper than a discount box store, but then you get what you pay for. Like most nurseries we do not grow most of our plants. We do grow a lot of roses and fruit trees, but not nearly enough. We shop from California's best growers and bring you the cream of the crop. Many of the plants we sell are hand selected by our staff at the growing grounds of leading growers. This is also allows us to find the "one" plant over looked by even the staff of the grower. Many a rose bush that was being sought out by someone has come about by our staff being in the field and hunting it down while shopping for general orders.

We typically have the largest selection of rose bushes fruit trees, Camellias and other plant than any other source in North America. Packing and shipping those plants is service that is provided to get those plants to you. When we charge you for the packing cost you are paying for about 20 minutes of labor, cardboard, wood, staples, wrapping, and protective materials, all of that for many shipments gets done for $8.50 a box, large fruit trees will run to $18.00. If you think that is not reasonable I am sorry, we do it is thrifty as possible.

Labor And Delivery Charges and Expenses 

We are not a landscape contractor, we are a California Nursery. Our interest is not general landscape work but in helping you create the best garden or landscape possible. We can provide labor or technical assistance in the planting of your plants. Unless prior arrangements are provided expect to be billed for a minimum of 1 hour of travel time for areas North of Fresno County and South of Kern County. Office time, office staff time is very valuable to us, we can share this time for $55.00 an hour. Labor rates are $28.00 per hour for general staff assistance and $85.00 per hour for senior technical assistance. Fuel costs are billed to the job or customer plus 15%. Delivery and drive time for special orders is $35.00 per hour for the driver, $28.00 for any assistants, plus expenses.

Expenses have 15% added to them. Truck rates are .23 cents per mile for light trucks, .38 cents per mile for medium pickup trucks and .48 cents per mile for 1 ton or larger cargo trucks. Deliveries with advance notice of 7 days or more range from $28.00 to $100.00 or more (for large to very large trees). Plant shopping, we will shop for special orders and get them at the lowest prices to us and add 1/2 of the cost to the invoice unless other arrangements have been written out. We usually get very good deals on plant material and can work to save you a lot of money.

Potted Plant Shipping

Potted rose orders take 1 to 14 days to fill, some take even longer depending on the type of rose you want. Not all plants are here in stock.  During the potted rose season availability can quickly change and many roses need to brought in from regional growers to fill your order. Out of State orders or small California will be shipped via commercial ground service. 

Make sure upon arrival the merchandise is what you wanted and meets your satisfaction. Do this by opening the top of the box only, DO NOT TEAR APART the package and then decide to return the merchandise. Returning the merchandise may be possible but will be a challenge if you have removed the plants from the box. Return of plants that been delivered  by us to you will result in the same or greater "pickup" charge than was for the delivery as regional deliveries are combined with others in your area to keep costs low.

Collections & Past Due Balances.

Customers trust us to fulfill our responsibilities, fill the order. We get this job done very effectively, when we do not the customer is entitled to a refund and if that does not happen the Buyer has legal recourse. If you the Buyer makes a purchase and that purchase has shipping charges due then it is Buyer's responsibility to make payment on their balance due.  Growquest  often ships items on a Purchase Order # or Check #. It is Buyer's responsibility to make payment on their outstanding balance. If your purchase was made with a credit card, then Buyer agrees that we will be bill or charge your credit for your shipping charges. Growquest  will forward Buyer the invoice and paper work for packing charges. All accounts are over due and payable within 10 days of the date of invoice. Over accounts will be incur a service charge of 2% per month. 

On large orders where some plant material may not be ready to ship all at one time Growquest  may bill packing and shipping charges for the amount of cargo that has left. In the event of a failure to pay or authorization to pay, Buyer agrees to pay for any outstanding shipping charges from the balance due of their paid but unshipped products.

In the event legal action is needed, the Courts of Jurisdiction shall be Ventura, County or the Southern California District of the United States Federal Court. Buyer assumes all reasonable attorney and legal costs uncured in collection any past due balance. 

Final invoices are subject to surcharges from DHL, UPS or other carriers. These are large boxes with special construction to make sure that the plants arrive in good shape. If the plant do not arrive in good shape you need to take a picture of the plant, package and send an email right away. The cheapest way to get your fruit tree sent to you is to have arrive at business location. Residential deliveries cost about $3.00 more per box.  

Preliminary Lien Notice & Material Release
For the benefit of the Buyer and ABP Growquest
Nursery, we may request information as to developer/owner, general contractor, and lender on all job sites prior to delivery on all shipments. A material release will be issued upon complete payment of account. Please make necessary arrangements prior to shipment. In the event of payment problems or issues arise ABP Growquest will file a lien as allowed under the laws of the State where the materials were delivered. In the event of a dispute all of the costs of this process are the burden of the buyer.

Non Warranty
ABP Growquest Nursery exercises the utmost care to keep all varieties true to name. However, each sale is made subject to the condition that should any plant material sold by it prove to be otherwise, ABP Growquest Nursery liability will be limited to the sum actually received by it for such material, and in no event shall it be held liable for any greater amount.

Limitation of Remedy: We warrant to the extent of the purchase price only that the seeds or plants sold here under are as described on the label within recognized tolerances. No other warranty is given, expressed or implied, (1) of the merchantability or fitness of the seeds or plants for any particular purpose, or (2) against loss due to any cause. We cannot accept any responsibility for the many uncontrollable growing and climatic conditions (soil preparation, fertilization, weed and pest control, temperature control, irrigation…etc.) that must be met to insure the success of your crop(s).
